You understand that upon initiating a transaction for availing the Services you are entering into a legally binding and enforceable contract with Khanderaya Traders for the Services.

Khanderaya Traders provides the following services:

• Milk Collection Services: We collect milk from farmers and maintain detailed records of quantity, quality, and pricing
• Payment Management: We process payments to farmers for milk supplied
• Advance Payment System: We provide advance payments to farmers as needed
• Cattle Feed Sales: We sell cattle feed and maintain purchase records
• Communication via WhatsApp: We use WhatsApp Business API to send transactional messages and service updates
• Digital Records: We maintain digital records of all transactions for transparency and convenience

3. User Accounts and Registration

3.1 Account Creation

To access and use the Services, you agree to provide true, accurate and complete information to us during and after registration, and you shall be responsible for all acts done through the use of your registered account on the Platform. To use our services, you must:

• Be at least 18 years of age
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Provide a valid phone number for WhatsApp communication
• Promptly update any changes to your information
• Be responsible for all acts done through your registered account

3.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your password
• All activities that occur under your account
• Notifying us immediately of any unauthorized access
• Ensuring your contact information is current

4. WhatsApp Communication

4.1 Messages We Send

By providing your phone number and using our services, you consent to receive messages via WhatsApp, including:

• Transaction Confirmations: Receipts for milk deposits, payments, and purchases
• Payment Notifications: Alerts about incoming payments, advance deductions, and account balances
• Account Updates: Monthly statements, payment schedules, and account summaries
• Service Announcements: Important updates about our services, rates, or policies
• Reminders: Payment reminders, collection schedules, and pending actions
• Customer Support: Responses to your inquiries and support requests

4.2 Message Frequency

Message frequency varies based on your activity:

• Daily: Transaction confirmations for milk deposits
• As needed: Payment notifications and reminders
• Monthly: Account statements and summaries
• Occasional: Service updates and announcements

4.3 Opting Out

You may opt out of non-essential messages by contacting us. However, you cannot opt out of critical transactional messages related to your account and services.

5. User Responsibilities

5.1 Farmers

As a farmer using our services, you agree to:

• Provide milk of acceptable quality standards
• Ensure accurate measurement and reporting
• Maintain proper hygiene and handling practices
• Repay advances as per agreed terms
• Notify us of any issues or concerns promptly
• Keep your contact information updated

5.2 Prohibited Activities

You agree not to use the Platform and/or Services for any purpose that is unlawful, illegal or forbidden by these Terms, or Indian or local laws that might apply to you. You must NOT:

• Provide false or misleading information
• Share your account credentials with others
• Attempt to access another user's account
• Manipulate or tamper with milk quality or quantity
• Use the service for any illegal purpose
• Interfere with the proper functioning of our services
• Reverse engineer or copy any part of our platform
• Violate any intellectual property rights of third parties

6. Milk Collection and Quality Standards

6.1 Quality Requirements

Milk supplied must meet our quality standards, including:

• Acceptable fat content (SNF) levels
• Freedom from adulteration
• Proper temperature and hygiene
• Compliance with food safety regulations

6.2 Rejection of Milk

We reserve the right to reject milk that does not meet our quality standards. Rejected milk will not be compensated.

7. Payment Terms

7.1 Payment Schedule

You agree to pay us the charges associated with availing the Services. Payments for milk supplied are processed according to our payment schedule, typically:

• Fortnightly or monthly payments (as per agreement)
• After deduction of advances, cattle feed purchases, and other dues
• Via bank transfer or other agreed methods

7.2 Pricing

Milk pricing is determined based on:

• Fat content (SNF) percentage
• Quantity supplied
• Current market rates
• Quality grade

We reserve the right to adjust pricing with reasonable notice.

7.3 Advances

Advances provided to farmers:

• Are subject to approval
• Must be repaid through milk supply deductions
• May carry interest charges as disclosed
• Are recorded and tracked in your account

8. Cattle Feed Sales

When purchasing cattle feed from us:

• Purchases are recorded against your account
• Payment is typically deducted from your milk payment
• Returns are subject to our return policy
• Quality complaints must be reported within 7 days

9. Intellectual Property

The contents of the Platform and the Services are proprietary to Khanderaya Traders and are licensed to us. You will not have any authority to claim any intellectual property rights, title, or interest in its contents. All content on our website and platform, including:

• Software, code, and technology
• Design, layout, look and graphics
• Text, logos, and trademarks
• Data compilation and organization

...are owned by Khanderaya Traders and protected by intellectual property laws. You acknowledge that unauthorized use of the Platform and/or the Services may lead to action against you as per these Terms of Use and/or applicable laws. You may not copy, reproduce, or distribute any content without our written permission.

10. Disclaimer of Warranties and Limitation of Liability

10.1 No Warranty

Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials offered on this website or through the Services, for any specific purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.

Your use of our Services and the Platform is solely and entirely at your own risk and discretion for which we shall not be liable to you in any manner. You are required to independently assess and ensure that the Services meet your requirements.

10.2 Limitation of Liability

To the fullest extent permitted by law:

• We provide services "AS IS" without warranties of any kind, express or implied
• We are not liable for indirect, incidental, or consequential damages
• In no event will Khanderaya Traders be liable for any indirect, consequential, incidental, special or punitive damages, including without limitation damages for loss of profits or revenues, business interruption, loss of business opportunities, loss of data or loss of other economic interests
• Our total liability, whether in contract, negligence, tort, warranty or otherwise, shall not exceed the amount paid by you for using the Services giving rise to the cause of action or Rupees One Hundred (Rs. 100), whichever is less
• We are not responsible for losses due to circumstances beyond our control

11. Service Modifications and Termination

11.1 Modifications

• Modify or discontinue services at any time

• Change pricing and payment terms
• Suspend services for maintenance

11.2 Termination by Us

We may suspend or terminate your account if:

• Your account remains inactive for extended periods

11.3 Termination by You

You may request account closure by contacting us. However:

• All outstanding dues must be settled
• Advances must be repaid in full
• We may retain records as required by law

12. Indemnification

You shall indemnify and hold harmless Khanderaya Traders, its affiliates, and their respective officers, directors, agents, and employees, from any claim or demand, or actions including reasonable attorneys' fees, made by any third party or penalty imposed due to or arising out of:

• Your breach of these Terms of Use, Privacy Policy and other Policies
• Your violation of any law, rules or regulations
• Your violation of the rights of a third party, including infringement of intellectual property rights
• Any damage caused to third parties through your use of the Platform or Services
• Any fraudulent, unlawful or unauthorized use of your account

13. Force Majeure

Notwithstanding anything contained in these Terms of Use, the parties shall not be liable for any failure to perform an obligation under these Terms if performance is prevented or delayed by a force majeure event. Force majeure events include but are not limited to:

• Acts of God, natural disasters, floods, earthquakes, epidemics or pandemics
• War, terrorism, riots, civil commotion
• Government actions, strikes, lockouts
• Failure of telecommunications, internet or power supply
• Any other circumstances beyond the reasonable control of the parties

14. Governing Law and Dispute Resolution

These Terms and any dispute or claim relating to it, or its enforceability, shall be governed by and construed in accordance with the laws of India.

In case of disputes:

1. Contact us first to resolve the matter amicably
2. If unresolved, disputes will be subject to mediation
3. All disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Barshi, Solapur, Maharashtra
